Modders cannot sell modifications where that mod or parts of it are only available with a purchase/fee. Server owners can't charge for specific items to be made available only for those who pay. If it's a mod that gives you as a player on a server any sort of advantage that someone who does not pay is not getting, and is not purely cosmetic, then it breaches the terms and conditions.
